POCSO act was passed in 2012 to address all the issue regarding child-centered sexual offences, on Friday certain amendments to the act was approved by the cabinet to make the act more gender Neutral thereby addressing the sexual acts against both boys and girls at same par, including the provision of death penalty when a child is under 12-years-old. Section 9 of the act has been more stringent, further the act would impose the hefty fine for not deleting, not destroying child pornographic material or not reporting child pornography. The Parliament had, earlier this year, passed the Criminal Law (Amendment) Act, 2018 making the rape of a girl below the age of twelve years an offence punishable with death thereafter an ordinance regarding the bill was brought in this April after the gang rapes in Unnao and Kathua earlier this year and the bill was passed in the monsoon session. The Bill was introduced to amend the Indian Penal Code to provide the death penalty for the gang rape of a girl less than 12 years, and 20 years in jail to the death penalty for rape of a girl less than 12 years, among others. The Union Cabinet approved changes to Section 6 of the POCSO Act, which deals with punishments for aggravated penetrative sexual assault, enhancing the punishment of 10 years to life imprisonment to 20 years to imprisonment for the remainder of a person’s natural life or with death.
