Lok Sabha passed the Muslim Women (Protection of Rights on Marriage) Bill, 2018 despite the opposition parties staged the protest by demonstrating a walkout when the government denied the proposal of referring the bill to joint select committee. The bill seeks to make triple talaq or instant divorce among Muslims a punishable offense.

The opposition parties demanded a parliamentary committee to closely scrutinize the bill. However, the government argued that the Supreme Court has already ruled in a landmark judgment last year that instant triple talaq is unconstitutional and arbitrary.  The debate continued for five long hours and bill was opposed by Congress and AIADMK but it was eventually passed by voice vote with a large margin of 245-11 votes. 

BJP chief Amit Shah demanded an apology from the Congress for decades of injustice meted out to Muslim women. He called the passage of the bill ‘historic’ and congratulated Prime Minister Narendra Modi and the government for successfully passing the bill in Lok Sabha. Law Minister Ravi Shankar Prasad also justified the Triple Talaq bill. He said the need for the passage of the bill was for humanity and not for religion so it should not be seen as ‘prism of politics’.

The bill will now go to Rajya Sabha and if passed, it will become a Law. However, opposition alleged that the bill is only a source to gain vote because it is hurriedly passed by the government with a view of the upcoming election. The bill was called unconstitutional and contravening the fundamental rights of the Muslims. The bill would send the husband in jail which would rather abandon the women. AIMIM's Asaduddin Owaisi said that the bill is in violation of their culture. He added that "In Islam, marriage is a contract. Talaq is a violation of the contract,” he said. Smriti Irani attacked the opposition and stated: “The contracts can’t be broken unilaterally.” The government strongly defended the measure and said that this bill should not be seen as a political move as 20 Islamic countries have already banned the practice.
