The Nagpur bench comprising of two-judge bench of Ravi K K Deshpande and VG Joshi of Bombay high court clubbed three petitions related to Bezonbagh Society. In the order, the court stayed the demolition of 22 unauthorized houses in Bezonbagh Pragatisheel Kamgar Gruh Nirman Sanstha’s layout till the final order in a writ petition filed by owners of unauthorized houses including Ranjana Anand Koch & others.
Advocate Shreerang Bhandarkar represented the petitioners and pleaded for regularization of the 22 houses. He cited a notification of the state government dated November 17, 2018, Urban Development Department’s (UDD) communication to Bezonbagh Society dated October 9, 2018, and petitioners’ application dated December 26 to divisional commissioner, collector and the Nagpur Municipal Corporation (NMC). He said it is the responsibility of divisional commissioner and NMC to comply with the government’s order. The court directed the agencies to file an affidavit for the same. Earlier too, on September 24, 2018, HC had dismissed a writ petition directing the divisional commissioner to continue the action. The action to demolish was earlier postponed as the petitioners approached apex court through special leave petition. Two of the houses were already demolished by district administration when they decided 20 houses to demolish on January 10.
