The Supreme Court of India has directed the immediate release of the journalist Prashant Kanojia who has been arrested for the release on the grounds of sharing the objectionable post against UP chief minister Adityanath. The Supreme Court has also stated that holding the liberty of the citizen is non- negotiable and sacrosanct which cannot be allowed to be infringed.
A vacation bench of Justice Indira Banerjee and Ajay Rastogi said that the statements that were made by the journalist on social media were objectionable and such kinds of comments should not be made but the arrest was not justified. The bench has also stated that “we do not appreciate the tweet that has been made by the journalist but how can he be put behind the bars. We disapprove the deprivation of liberty of the journalist by the state action. Justice Banerjee has asked that how can an arrest be made over the tweets to which the Additional Solicitor General on behalf of the UP Government has replied that Prashant Kanojia has made impulsive tweets against Gods and Religion on the previous occasion and that is why an offense of public mischief under Section 505 of IPC was added in the list of charges.
Prashant Kanojia was arrested for posting a video on his Twitter and Facebook account of a woman who is speaking to the reporters of various media organizations outside the CMs office, expressing her desire to marry Yogi Adityanath and claiming that she has sent a marriage proposal to him.
