Advocate Shadan Farasat appearing for CPI (M) General Secretary Sitaram Yechury has filed a writ petition in the Hon’ble Supreme Court before the bench of Justice NV Ramana for issuing a Habeas Corpus to produce Mr. Mohammed Yousuf Tarigami. Tarigami was a four time MLA OF CPI(M) from Kulgam in the now dissolved Jammu and Kashmir assembly and was 72 years old. He was detained on August 5 on the backdrop of ceentral government measures to revoke the special powers of the state.
Sitaram Yechury had travelled to Srinagar with CPI leader D Raja to meet Mohammed Yousuf Tarigami, earlier this month as he wasn’t keeping well without a prior notice to the governor of Jammu and Kashmir. But they were detained at the Srinagar airport and were denied entry to the city citing law and order problems. Therefore they filed the writ and contended that it violated the right to life and personal liberty guaranteed under Article 21 of the Constitution and he filed so because there was absolute lack of information and whereabouts of Mohammed Yousuf Tarigami who is suffering from age related problems. Justice Ramana directed that the matter shall be listed before an appropriate Bench on August 26 as per the roster.
