The Supreme Court agreed to hear pleas which had challenged the newly formed law that is, Triple talaq and which is being challenged to be a criminal offence. Hon'ble Mr. Justice. N.V. Ramana and Hon'ble Mr. Justice Ajay Rastogi issued a notice to the centre and claimed that this provision of triple talaq violates the provisions of the constitution.
The triple talaq which was ammended in 2019 contained that any person giving instant talaq to his wife, will be punished with three years of imprisonment with a fine. The person doing such offence can be arrested without a warrant. Petitions challenging the criminalization of instant triple talaq were filed by Samastha Kerala Jamiathul Ulema, a religious organization of Sunni Muslim scholars; Amir Rashid Madni, a politician and Islamic scholar; and Jamiat Ulama- I- Hind.
The petitioners said that this bill has violated their fundamental rights such as- Article 14, 15 and 21 of the Constitution of India. In Delhi High Court, the petition contained that the new legislation which criminalised the tripal talaq among the Muslims, would shut down all room for compromise between the husband and wife.
Thus the Supreme Court seeked response from the centre adainst the challenges to the bill of triple talaq and has agreed to hear pleas against this act and has also issue a notice against the centre on the same. However there will be no stay for triple talaq Act.
