  • On 27 March Supreme Court issued order that the sale of BS IV vehicles will be allowed for 10 days after the lockdown was lifted in India

Supreme Court said that no BS 4 vehicles to be registered till the decision on the sale during the lockdown.


Supreme Court has asked automobile dealers association for details of the sale of vehicles through online or direct sale during the lockdown period.


Bharat stage emission norms and standards instituted by the government to regulate air pollutants from motor vehicles the BS4 norms have been and forth across the country since April 2017.


In 2019 as the air quality became worse, the decision was taken that the BS 4 vehicles will not be sold after March 31 st 2020.


The supreme court directed that no BS 4 vehicles will be registered with the authorities until the court decides on the issue of sale of these vehicles during the lockdown period.

The bench also comprised Justice B R Gavai and Justice Krishna Murari.


The Supreme Court was earlier irked over the violation of this order and had pulled up the automobile dealers association by saying that BS 4 vehicles sold during the lockdown in the last week of March and after March also.


You are in great trouble we will prosecute somebody the bench told the counsel appearing for the dealers association.


We will take appropriate actions against these fellows the bench said while surging to the number of violations.
The matter has been posted for further hearing on August 13.


The court on July 24 had expressed annoyance over this and a plea filed by automobile dealers association seeking that dealer should be allowed to return on the sold inventory of BS4 vehicles to the manufacturers so they could be exported to other countries.


The association has said that there are some countries where the sale of BS4 vehicles are still allowed.

However, the bench had said that "why should we pass orders for that, manufacturers were aware of the deadline."


Justice Arun Mishra said that please do not take advantage of this court by playing fraud you have told that no sales have taken place you are understating your value.


No vehicles could be registered without our order you have sold more than the allowed.


it would be a violation of the spirit of the court order if we allow sales after the opening of the lockdown the apex court said.
